Terms & Conditions of Business

    1. These terms and conditions between Executive Sales Recruitment Specialists Ltd (hereafter called the company) and the employer (hereafter called the client) are deemed to be accepted as an introduction by virtue of their receipt of a curriculum vitae, interview or engagement (which term includes employment or use, whether under a contract of service or services) of the said applicant howsoever introduced by the company.
    2. All fees payable are due immediately on receipt of invoice and should be made payable to Executive Sales Recruitment Specialists Ltd
    3. Any invoices which remain unpaid after 14 days will result in the client losing the entitlement to any rebate whatsoever and/or any discount granted.
    1. Fees are calculated as the percentage of the first year’s salary, as follows:

      £5,000-£19,999 charged at 20 %
      £20,000+ charged at 25%
    2. VAT shall be charged on all fees at the prevailing rate.
    3. If, within six months of the date of introduction, any applicant introduced by the company is engaged by the client or by another party to whom the client has introduced the said applicant these conditions of business will apply.
    4. Should the engagement terminate for any reason except redundancy before the expiry date of 8 weeks the fee will be credited in accordance with the following scale of rebate, provided that the client notifies the company in writing within 7 days of the termination of engagement and the fee has been paid within 14 days of the commencement of engagement. Should the client or any subsidiary or associated company of the client subsequently re-engage the applicant within six months from the date of termination a full fee will become payable.

      SCALE OF REBATE
      1st - 4th week of employment - 100% (full rebate)
      5th week of employment - 75%
      6th week of employment - 50%
      7th week of employment - 25%
      8th week of employment - 0% (no rebate)
    5. The company can accept no liability whatsoever on behalf of the clients, their servants or agents for any loss, damage, costs or expenses howsoever caused which the client may suffer as a result of the introduction of an applicant.
    6. No variations can be made to these Terms of Business unless made in writing by a Director.
